Terms & Conditions of Use

How Mirage works from a legal point of view: who can use it, what you can (and cannot) do, and how rights around cards, Remixes and Crystals are handled.

Scope & acceptance

Mirage is an ethical artificial intelligence application that lets you reuse artists’ original content with the consent of rights holders. Unless specifically authorised by the relevant rights holders, voice cloning, commercial use and exporting content outside the Application are prohibited.

By downloading, installing or using the Mirage application (the “Application”), you unreservedly accept these Terms & Conditions of Use (the “Terms & Conditions”), together with Mirage’s Privacy Policy. If you do not agree, you must not use the Application.

These Terms & Conditions govern access to and use of the Application and bind all users (the “User” or “you”). Mirage may modify them at any time, for example to reflect legal or product changes. Updated versions are made available in the Application. If you do not accept an update, you must stop using Mirage and delete your Account.

Mirage application

Mirage is a freemium mobile game that combines digital collectible card decks (“Mirage Cards”), music creation via generative artificial intelligence (“Mirage AI”) and community sharing features such as Radio, Charts and Clash of Sounds.

The Application is currently available in France only (the “Authorised Territory”). Some features, content, cards or events may only be available for a limited time or to certain users, at Mirage’s discretion.

Mirage owns the Application and all associated intellectual property rights, including Mirage AI, the structure and layout of the Application, design and graphics, logos, texts, sounds, videos, tools, software and databases, as well as the Mirage trademark.

  • No ownership right in the Application, Mirage AI or the content is transferred to you.
  • All elements remain the exclusive property of Mirage or its partners.
  • You undertake not to contest, infringe or misuse these rights in any way.

Mirage grants you a revocable, personal, non-exclusive, non-transferable licence to install and use one copy of the Application, in executable object code only, on your personal mobile device, solely for your own non-commercial use and strictly within the scope of these Terms & Conditions.

Users & accounts

To be authorised to use Mirage, you must: (i) be at least 13 years old; (ii) if you are between 13 and 15, have the permission of one of your parents; (iii) reside in the Authorised Territory; (iv) act as a non-professional consumer; (v) not have been previously prohibited from using the Application; and (vi) have created an Account in accordance with this section.

By using Mirage, you confirm that you meet all of these conditions and that any information you provide is accurate, complete and kept up to date.

Authorised users

If you do not meet the eligibility criteria, you must not create an Account or use the Application. Mirage may carry out checks and suspend or delete Accounts that do not comply with these conditions.

Account creation

You can create an Account using: (1) the registration form, or (2) Apple ID Connect, or (3) Google Connect. When doing so, you must provide the following mandatory information: valid email address, nickname, date of birth, country of residence and password.

You may also optionally provide: first and last name, profile photo, gender, phone number and musical interests. This data is processed in accordance with Mirage’s Privacy Policy. You must inform Mirage of any changes so that this information remains accurate.

Management of login details and linked services

Your username and password are confidential and you are responsible for keeping them safe. You must not share them with third parties. You are responsible for all use of your Account. Mirage cannot be held liable for unauthorised use of your login details. Subject to the applicable third-party terms, you may choose to link your Account to third-party platforms (for example Spotify or Apple Music).

Mirage Cards

Mirage Cards give you temporary, limited rights to use original musical and audiovisual content (“Original Content”) within the Application. They are digital items which can be collected, combined and played in the Studio, Radio and Clash of Sounds.

Mirage Cards are provided “as is”. They rely on Mirage AI and on licence agreements entered into with rights holders. Features, availability, appearance rates and lifetime of Cards may change over time and may be interrupted at any moment to comply with these agreements.

Card types and features

  • Track Cards: a music track (master + publishing) available for listening in Mirage, used as the creative base and structural backbone for Remixes.
  • Artist-Singer Cards: focus on a vocalist’s style and interpretation (rhythm, dynamics, intention) without cloning the voice. Voice cloning is not permitted without express consent of the artist.
  • Artist-Musician Cards: represent a musician’s playing style (e.g. guitar, piano, drums) and allow you to add characteristic stylistic motifs to the Remix.
  • Instrument Cards: focus on a specific timbre or instrument (for example a jazz-soul electric piano texture, or a saturated rock guitar), used to transform or add instrumental layers.
  • Effect Cards: represent audio production treatments (chorus, delay, reverb, saturation, autotune, lo-fi filters, etc.) and can significantly shape the sound of a Remix.
  • DJ Cards: model performance and transition techniques (crossfading, scratching, beatmatching, live cutting, etc.) and are particularly relevant for Clash of Sounds competitions.

Availability and withdrawal

Because Mirage Cards may involve third-party rights, their availability is precarious. Listing, holding, acquisition and use of a Card may be interrupted at any time in order to comply with rights holders’ requirements. Mirage may indicate an estimated lifetime for certain Cards and may, at its discretion, grant in-app compensations if Cards are withdrawn early.

Rarity levels and drop rates

Mirage Cards are classified by increasing rarity (Classic, Rare, Legendary). Rarity influences the amount of Crystals or engagement required to obtain them and their appearance rate in Packs. Mirage may adjust appearance rates to reflect musical or cultural events and will communicate updated drop rates in the Application.

  • Classic: the most common Cards, form the core of the deck and progression.
  • Rare: less frequent Cards with higher perceived creative or cultural value.
  • Legendary: the rarest Cards, which may include special animations, visuals or additional options (for example unlocked stems), without significantly impacting gameplay balance.

Acquisition of Mirage Cards

You can obtain Mirage Cards for free (daily logins, missions, rewards, gifts) or by purchasing Packs with Crystals via the Pack Menu. Packs contain a random selection of Cards according to the applicable drop rates. Purchasing Packs does not entitle you to win anything and you must not expect any monetary gain.

Authorised use of Mirage Cards

Owning a Mirage Card grants you a personal, revocable “playback right” within the Application: you may listen to or view the underlying Original Content and use it in the Studio to generate Remixes. These rights are non-exclusive, non-transferable, non-assignable, strictly non-commercial and limited to use inside the Application.

By default, you are prohibited from exporting or sharing Original Content, Mirage Cards or Remixes outside the Application. As an exception, Mirage may offer Exportable Cards, Cleared Cards and Exportable Remixes that can be reused on specific third-party platforms under strict conditions notified at purchase (duration, attribution or watermark, commercial restrictions, revenue sharing, etc.). Any use for AI training, database extraction or external commercial exploitation is prohibited.

Studio & Mirage AI

The Studio is the interface in the Application that allows you to generate Remixes from Mirage Cards using Mirage AI. Remixes are generated in a controlled environment: users cannot upload their own audio or use free text prompts.

Mirage AI is an innovative and evolving technology. Mirage provides the Studio “as is”, without guaranteeing that Remixes will be free of approximations, artefacts or similarities with existing works. Mirage cannot guarantee that any Remix is original, lawful or free of rights.

Mirage will implement safeguards to avoid identical reproductions of Original Content, including technical filters and internal monitoring. However, you remain solely responsible for how you use Remixes, and you must not use them in a way that infringes third-party rights. Mirage may block or delete any Remix that appears non-compliant, infringing or otherwise problematic.

Crystals, subscriptions & in-app purchases

Crystals are a virtual currency that can be earned by playing (for example daily logins, missions, in-game rewards, events) and purchased through in-app purchases in the store of the platform from which you downloaded Mirage (Apple App Store or Google Play). Crystals are used to open Packs, acquire Mirage Cards and, over time, unlock certain premium content or events.

Crystals only exist inside the Application. They have no monetary value, cannot be transferred or exchanged with other users or third parties, and can never be converted back into real money. Mirage may manage, regulate, limit or delete Crystals and Cards, for example in case of breach of these Terms & Conditions, account closure, service interruption, or expiry of underlying rights.

Purchases of Crystals

All purchases of Crystals are final and non-refundable, except in the case of a technical error attributable to Mirage. You have no withdrawal right once digital content has been supplied. Payments are processed by Apple or Google, and you agree to their respective terms of use. Mirage cannot be held liable for malfunctions, delays or incidents linked to those platforms.

Subscriptions

Mirage may offer paid subscription plans providing additional benefits (for example reduced advertising, advanced Studio features, exclusive content or daily rewards). The applicable conditions (price, duration, renewal, billing) are indicated in the Application at the time of subscription.

Payment and billing

Payments for Crystals and Subscriptions are handled through Apple’s in-app purchase system or Google Play Billing, depending on where you downloaded the Application. Mirage does not collect your full payment details and cannot be held responsible for issues arising from these payment services.

Intellectual property

Original Content (including Mirage Original Content), Mirage AI, the Application, Mirage Cards and Remixes are protected by intellectual property rights owned by Mirage and/or its partners and licensors. You do not acquire any ownership right over this content by using Mirage or generating Remixes.

Any use of content beyond what is expressly permitted in these Terms & Conditions may constitute an infringement and could lead to civil and/or criminal liability. You must not copy, modify, translate, publish, distribute, perform, reverse engineer or attempt to extract any source code, or create derivative works from the Application, Mirage AI, Original Content or Remixes, except where strictly allowed (for example in accordance with the conditions attached to Exportable Cards and Cleared Cards).

Original Content

Original Content remains the exclusive property of Mirage or its partners. Mirage only grants you strictly limited, revocable rights of use inside the Application via Mirage Cards. You must not contest these rights or attempt to bypass technical measures that protect the content.

Remixes and Mirage’s rights

Remixes are generated mechanically using Mirage AI from Original Content and Mirage Cards. To the extent you might hold any rights over a Remix, you acknowledge that any external use would require the prior authorisation of the owners of the underlying Original Content, and you therefore refrain from any such use unless expressly granted under these Terms & Conditions.

Where necessary, you grant Mirage a non-exclusive, transferable, sublicensable, royalty-free worldwide licence for the legal term of protection, to reproduce, represent, distribute, adapt, modify and create derivative works from the Remixes in which you participate, in any format and media, in connection with the Application and Mirage’s activities, including for marketing and social media. Mirage may also make your Remixes available to other users in the Studio and on Radio, in accordance with the options you select.

Moderation, charts & partners

Mirage may implement technical and human moderation measures to ensure the quality of Remixes, compliance with laws and respect for third-party rights. These measures may evolve over time as the service grows.

  • Source filtering and safeguards designed to limit abusive or sensitive combinations.
  • Internal technical fingerprints and logs for Original Content and Remixes.
  • Manual review of the most visible or popular content.
  • An opt-out mechanism for rights holders and partners, as well as enforcement of user commitments.

Referencing and presentation

Content in Mirage (Cards, Packs, Remixes) may be sorted and displayed according to various criteria, such as rarity, date added, popularity, musical category or editorial selections and themed Packs chosen by Mirage. Mirage may delist or reclassify content at any time, in particular to protect intellectual property rights or adapt the game balance.

Charts, Radio and rewards

Mirage may run rankings and Charts based on the popularity of Remixes (for example likes, boosts or other signals). Depending on their position, users may receive in-app rewards such as Crystals or Cards, under conditions specified in the Application.

Advertising, links and partnerships

The Application may contain advertisements, links to third-party sites or partner operations (for example referral programmes, concerts, ticketing or merchandise). Mirage is not responsible for the content, availability or practices of these third parties. Any paid subscription that limits advertising will be described in the Application. Your use of third-party services is governed by their own terms and privacy policies.

Notification & removal of illegal content

If you become aware of content that you believe is illegal or infringes third-party rights, you must notify Mirage using the reporting mechanism or form indicated in the Application, providing the required information.

Mirage will act promptly with respect to clearly illegal content and may remove or disable access to it, while assessing the situation in good faith.

How to notify Mirage

Your notification should include: (i) a sufficiently detailed explanation of why the content is illegal or infringing; (ii) a precise indication of where it appears in the Application; (iii) your name and a valid email address; and (iv) a statement confirming that you genuinely believe the information you provide is accurate and complete.

Removal, counter-notification and hosting liability

Mirage may remove or restrict access to reported content. If you believe that your content has been wrongly removed, you may submit a counter-notification explaining why you consider it lawful. Mirage cannot be held liable for information stored on the Application if it had no actual knowledge of its illegal nature, or acted promptly upon becoming aware of it.

Term, account closure & liability

Your rights of use over Mirage, Mirage Cards and Remixes are strictly limited to the duration of your use of the Application as a registered User with a valid Account. These rights automatically end when you stop using the Application or when your Account is closed or deleted. Mirage may terminate or limit your rights at any time, in particular to comply with the rights of third parties or in case of breach of these Terms & Conditions.

Any breach of your obligations under these Terms & Conditions may justify suspension, closure or deletion of your Account, temporary or permanent, without prejudice to Mirage’s right to seek damages or prevent re-registration in serious cases.

Closing your Account

You may request the closure or deletion of your Account, in particular under applicable data protection laws, by contacting Mirage’s customer service using the details indicated below. Mirage may retain certain information where required or allowed by law.

If Mirage decides to close or delete your Account for breach of these Terms & Conditions, it will inform you of the main reasons, and you may provide explanations. Mirage may nevertheless maintain suspension or closure in order to protect the service, other users or rights holders.

Service “as is” and limitation of liability

Mirage provides the Application, Studio, Mirage AI, Cards and Remixes “as is”, without any guarantee of uninterrupted availability, freedom from errors, or suitability for a particular purpose. Mirage does not guarantee that the service will meet your expectations or that Remixes are free of infringement risks. To the extent permitted by law, Mirage shall not be liable for any indirect, special, consequential or punitive damages, nor for any loss of profit, data, business or goodwill resulting from the use or inability to use the Application.

Personal data and privacy

In using Mirage, you provide Mirage with certain personal data. Their collection and use are governed by Mirage’s Privacy Policy, which explains what data is processed, for which purposes, for how long, and which rights you have. By using Mirage, you agree to read and comply with that Privacy Policy.

Governing law and dispute resolution

These Terms & Conditions are governed by French law. In the event of a dispute relating to their validity, interpretation or performance, Mirage and the User will first seek an amicable solution, including by using a consumer mediation scheme where applicable, or the European Commission’s online dispute resolution platform. Subject to mandatory local rules, the competent courts in Paris, France shall have jurisdiction.

Key definitions & final provisions

For the purposes of these Terms & Conditions, capitalised terms used in the Application have the following meanings, in particular:

  • “Application”: the Mirage mobile application as described in these Terms & Conditions, including the Studio, Radio, Charts, Pack Menu and other in-app features.
  • “Mirage Card”: a digital item that grants a limited, revocable playback and use right over specific Original Content inside the Application, such as Track Cards, Artist-Singer Cards, Artist-Musician Cards, Instrument Cards, Effect Cards and DJ Cards.
  • “Remix”, “Crystals”, “Exportable Cards”, “Cleared Cards”, “Exportable Remixes”, “Subscription”, “Season”, “Clash of Sounds”, “Mirage Soundtrack Licence” and other capitalised terms have the meaning given to them in the full legal Terms & Conditions available in-app.

Severability, non-waiver and language

If any provision of these Terms & Conditions is found to be invalid, illegal or unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. No failure or delay by either party to exercise a right shall be construed as a waiver. You may not assign or transfer your rights or obligations under these Terms & Conditions without Mirage’s prior written consent. In the event of any discrepancy between language versions, the English version shall prevail.
